Terms and Conditions

I consent and agree to the following BURN FITNESS guidelines:

1.You must enter the front door ONLY (Promenade entrance).

2. A face mask is required and to be worn properly at all times (covering nose and mouth). We will sell extra masks and personal hand sanitizer bottle at cost upon request.

3. Upon reaching the front desk your temperature will be taken, answer a quick health questionnaire, sign a liability waiver, and use provided hand sanitizer station. You're in!

4. While working out, proper social distancing will be required. Please stay at least six feet from others at all times.

5. Multiple wipe stations with disinfectant and microfiber towels (within a few feet of all equipment) will be used before and after each use.

6. Please bring your own towel for personal use for showers and/or workouts. We will have a towel service for emergencies only.

7. The water fountains and saunas will be closed until further notice.

8. Wash your hands with soap and hot water, in the locker room, often. We can provide personal hand sanitizer bottle at cost upon request.

9. Exit the club ONLY through the back door (4th Street). Parking structure is directly behind the club.

Assumption of Risk and Wavier of Liability Agreement

By checking this box, I understand that participation at Burn Fitness 2, LLC (“BURN FITNESS”) and the use of their exercise equipment may be hazardous and may result in my injury, loss, damage, or death. I agree that I am personally responsible for my safety and actions while at BURN FITNESS and while using their facilities, equipment, and classes, and for taking every precaution to provide for my safety and well-being. I agree to conduct myself in a controlled and reasonable manner, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose. I understand that my failure to abide by this Agreement may result in revocation of my right to participate with, access, and use BURN FITNESS and its facilities, equipment, and classes.
I agree to comply with all BURN FITNESS policies, rules, guidelines, signage, and instructions, whether stated herein or displayed at BURN FITNESS. I agree, represent, and warrant that I will not visit or utilize BURN FITNESS within 14 days after (i) having a fever, cough, or shortness of breath; (ii) returning from highly impacted areas subject to a CDC Level 3 Travel Health Notice; (iii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice; or (iv) exposure to any person who has a suspected or confirmed case of COVID-19. I understand and appreciate both the known and potential dangers of utilizing BURN FITNESS’ facilities and services, including that my use thereof may result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death. I agree to immediately notify BURN FITNESS if I am diagnosed with COVID-19 or if I have been exposed to any person who has a suspected or confirmed case of COVID-19
IN CONSIDERATION FOR BEING PERMITTED TO USE BURN FITNESS’ FACILITIES, CLASSES, AND EXERCISE EQUIPMENT, I, ON MY BEHALF AND ON BEHALF OF MY FAMILY, SPOUSE, ESTATE, HEIRS, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND PERSONAL REPRESENTATIVES, EXPRESSLY AGREE TO AND FULLY AND FOREVER RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE BURN FITNESS, AND ITS MEMBERS, OFFICERS, AGENTS, SERVANTS, INDEPENDENT CONTRACTORS, AFFILIATES, EMPLOYEES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION, DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES, ANY THIRD-PARTY USING BURN FITNESS, OR OTHERWISE, WHILE PARTICIPATING IN ANY ACTIVITY WHILE IN, ON, OR AROUND BURN FITNESS, AND/OR WHILE USING ANY BURN FITNESS FACILITIES, TOOLS, EQUIPMENT, OR MATERIALS.
I expressly agree to accept the risks of using BURN FITNESS’ facilities, equipment, and classes, and will indemnify and hold BURN FITNESS harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from my injuries or damages.
I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY. I UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS. I HAVE VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
