Terms and Conditions

Because physical exercise can be strenuous and subject to the risk of serious injury, RSTR urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (each client, guest, and all participating family members) agree that if you engage in any physical exercise or activity, or use any gym amenity on the premises or off-premises, including any sponsored gym event, you do so entirely at your own risk. Any recommendations for changes in diet, including the use of food supplements, weight reduction and/or bodybuilding enhancement products are entirely your responsibility, and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of 1) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction;, 2) the sudden and unforeseen malfunctioning of any equipment; 3) our instruction, training, supervision, or dietary recommendations; 4) your slipping and/or falling while in the building, or on the premises, including adjacent sidewalks and parking areas; 5) contact with other participants; 6) the effects of the weather, including high heat and/or humidity; and all other such risks being known and appreciated by me. I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in any activities.

I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and RSTR furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE RSTR, its owners, its officers, agents, employees, organizers, representatives, and successors from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the facility for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, and employees.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision or provisions severed herefrom.

By entering the premises of RSTR LLC (“RSTR”), purchasing RSTR products or services, or participating in RSTR activities, I agree to and acknowledge the following:

I acknowledge that the CDC and other public health authorities still recommend practicing social distancing and other forms of protection.

I further acknowledge that RSTR has put in place preventative measures based on CDC guidelines and I will abide by any required measure of me.

I voluntarily seek services provided by RSTR and acknowledge that I comply with all set procedures to reduce the spread of Coronavirus/COVID-19 while attending my workout.

I attest that:
* I observe and will continue to observe the CDC recommended guidelines.
* I will only enter RSTR if I am NOT experiencing any symptom of illness such as, but not limited to, cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I will only enter RSTR if I have NOT traveled internationally within the last 14 days.
* I will only enter RSTR if I have NOT traveled to a highly impacted area within the United States of America in the last 14 days.
* If I believe that I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19, I will NOT enter RSTR until after a 14-day self-quarantine.
* I have not been diagnosed with Coronavirus/COVID-19.
*If I have been diagnosed with Coronavirus/COVID-19, I have been cleared as non-contagious by state or local public health authorities.

I hereby release and agree to hold RSTR harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of RSTR, or that may otherwise arise in any way in connection with RSTR membership. I understand that this release discharges RSTR from any liability or claim that I, my heirs, or any personal representatives may have against the RSTR with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any time spent at RSTR. This liability waiver and release extends to RSTR together with all owners, partners, and employees.
