Terms and Conditions
1. That I am participating in The Madison Improvement Club’s (“The Madison”) classes, workshops and other activities and using The Madison’s premises, facility and equipment during which I will participate in and receive information including instruction about yoga, indoor cycling, workshops or events, and health. I recognize that yoga, indoor cycling, and other activities that I voluntarily undertake at The Madison require physical exertion that may be strenuous and may cause physical injury. I recognize that The Madison uses music and light effects in its classes, workshops and other activities. I acknowledge that I choose to be exposed to this music and lighting, and if the music sound levels cause me any concerns, I should wear hearing protection, such as ear plugs. I am fully aware of the risks and hazards involved with the activities that I may undertake at and through The Madison.
2. Because physical exercise can be strenuous and subject to risk of serious injury, I acknowledge that The Madison urges me to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the yoga classes, indoor cycle classes, workshops or events at The Madison. I represent and warrant that I am physically fit and that I have no medical condition that would prevent my full participation in the yoga classes, indoor cycle classes, workshops or events. I acknowledge that any recommendation for changes in diet including the use of food supplements, weight reduction and or body building enhancement products are entirely my responsibility and I should consult a physician prior to undergoing any dietary or food supplement changes.
3. I agree that if I engage in any physical exercise or activity, or use any amenity on the premises or off the premises including at any sponsored event, I do so entirely at my own risk and responsibility. I agree that I am voluntarily participating in these activities and use of these facilities and premises and agree to assume all risks of injury, illness, damage, or death, known or unknown which I might incur as a result of participating in the program. The Madison is also not responsible for any loss of my personal property.
4. This waiver and release of liability includes, without limitation, all injuries which may occur as a result of, (a) my use of all amenities and equipment in the facility and my participation in any activity, class, program, personal training or instruction (e.g. attempted yoga positions, etc.), to include music, lighting, heating provided therewith, (b) the sudden and unforeseen malfunctioning of any equipment, (c) our instruction, training, supervision, or dietary recommendations, and (d) my slipping and/or falling while in The Madison, or on The Madison premises, including adjacent sidewalks and parking areas.
5. In further consideration of being permitted to participate in yoga classes, indoor cycle classes, workshops or events, I knowingly, voluntarily and expressly waive any claim I may have against The Madison for injury or damages that I may sustain as a result of participating in the program. I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge The Madison, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against The Madison for personal injury or property damage.
6. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of The Madison, its agents, and employees. I, my heirs, or legal representatives forever release, waive, discharge and covenant not to sue The Madison for any injury or death caused by their negligence or other acts.
7. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed herefrom.
I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above. By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.

The Madison is also not responsible for any loss of my personal property.

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of, (a) my use of all amenities and equipment in the facility and my participation in any activity, class, program, personal training or instruction (e.g. attempted yoga positions, etc.), to include music, lighting, heating provided therewith, (b) the sudden and unforeseen malfunctioning of any equipment, (c) our instruction, training, supervision, or dietary recommendations, and (d) my slipping and/or falling while in The Madison, or on The Madison premises, including adjacent sidewalks and parking areas.
5. In further consideration of being permitted to participate in yoga classes, indoor cycle classes, workshops or events, I knowingly, voluntarily and expressly waive any claim I may have against The Madison for injury or damages that I may sustain as a result of participating in the program. I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge The Madison, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against The Madison for personal injury or property damage.
6. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of The Madison, its agents, and employees. I, my heirs, or legal representatives forever release, waive, discharge and covenant not to sue The Madison for any injury or death caused by their negligence or other acts.
7. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed herefrom.
I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above. By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.
