Terms and Conditions

 

I understand that a participant must be at least 14 years of age or older to participate in a class at Rebel Murrieta and further understand that only persons 18 years or older have the capacity to give consent and agree to the following terms and conditions to participate in classes at Rebel Murrieta.  I am, either, at least 18 years of age and can consent and agree to the following terms and conditions on my own behalf OR I am at least 18 years of age and am the legal guardian or parent of a participant who is between the ages 14-17, and I hereby give my consent to participate in classes at Rebel Murrieta and allow for emergency medical treatment for my son and/or daughter and assume the responsibility for payment of such treatment.

 

I, as a participant who is at least 18 years of age or a legal guardian or parent of a participant who is between the ages of 14-17, agree to release, indemnify and hold harmless Rebel Murrieta, its owners, staff personnel, agents, contractors, officials, representatives, and owners to facility, building and property, (individually and collectively hereinafter referred to as Indemnitees) from any claims, losses, causes of action, damages, injuries or liability whatsoever based or asserted upon any acts, omissions or services of Indemnitees, arising out or in any way relating to the use of or entry upon this Rebel Spin facility or the property, including but not limited to to property damage, bodily injury, or death or any other element of any kind or nature.

 

By signing up for and/or attending Rebel Murrieta classes, activities and other programs, and using Rebel Murrieta's premises, facilities, and equipment (collectively, Classes and Facilities), you hereby agree that there are certain inherent risks and dangers in indoor cycling and exercise and in using indoor cycling and exercise equipment in association with the Classes and Facilities. In consideration of being allowed to participate in and access the Classes and Facilities provided by Rebel Murrieta, in addition to the payment of any fee or charge, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities, (2) waive, release and forever discharge Rebel Murrieta, its officers, agents, members, employees, representatives, and all others from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to your person or property resulting from your participation in and use of the classes and Facilities, and (3) represent you have no medical or physical condition which would prevent you from attending and/or using any of Rebel Murrieta's classes and Facilities and/or put you in any physical or medical danger, and have not been instructed by a physician not to do so. Rebel Murrieta hereby advises you that individuals with any chronic disabilities or conditions are at risk in using Rebel Murrieta's classes and Facilities, and are advised against doing so. In addition, if in the opinion of Rebel Murrieta staff, you would be at physical risk using Rebel Murrieta's classes and Facilities, you will be denied access to Rebel Murrieta and its classes and Facilities until you furnish Rebel Murrieta with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing Rebel Murrieta's concerns, and stating that Rebel Murrieta's concerns are unfounded. If you decline to obtain such a letter, you will not be permitted to use the classes and Facilities of Rebel Murrieta. Rebel Murrieta reserves the right to refuse service at its discretion.
